1.1. Introduction

Thank you very much for visiting our website. We take data protection very seriously, and it is our wish to protect your personal data within the framework of our website service.
Personal data refers to all information concerning personal and factual conditions of a natural person. The personal data collected on our website is used exclusively for our own purposes.

 

1.2 Legal bases of data processing

Consent
Insofar as your consent is sought for processing operations of personal data, the legal basis for data processing is point (a) of Art. 6(1) EU General Data Protection Regulation (GDPR).

Contract
Whenever processing of personal data is necessary for the performance of a contract to which you are party, the legal basis is point (b) of Art. 6(1) GDPR. This is also valid in the case of processing which is necessary for the performance of steps taken prior to entering the contract.

Legal obligation
Whenever processing of personal data is necessary for compliance with a legal obligation to which our company is subject, the legal basis is point (c) of Art. 6(1) GDPR.

Vital interests
Whenever processing of personal data is necessary in order to protect your vital interests or those of another natural person, the legal basis is point (d) of Art. 6(1) GDPR.

Legitimate interest
Whenever processing of personal data is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, then the legal basis for processing is point (f) of Art. 6(1) GDPR. The legitimate interest of our company is conducting our business.

 

1.3 Rights of the data subjects

In connection with our data processing, personal data pertaining to you is processed. You are entitled to the rights laid down in Chapter 3 GDPR vis-à-vis our company.
We respect the rights to access, rectification, restriction of processing, deletion or portability of your personal data. You shall have the right to consult our data protection officer concerning these rights as well as concerning all queries relating to the processing of your personal data. You may assert these rights as follows:

Right of access (Art. 15 GDPR)
You have the right to obtain confirmation from us as to whether or not we are processing personal data relevant to you. If this is the case, you have the right of access to this personal data and to the following information:

  • The purposes of the processing and the categories of personal data which is being processed;
  • The recipients or categories of recipients to whom the personal data has been or will be disclosed;
  • the envisaged period for which the data will be stored or the criteria used to determine that period;
  • The existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning your person or to object to such processing;
  • The right to lodge a complaint with a supervisory authority;
  • where the personal data is not collected from the you directly, any available information as to its source;
  • the existence of automated decision-making, including profiling and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

We provide you with a copy of the personal data undergoing processing. For any further copies you request we may charge a reasonable fee based on administrative costs. Where you make the request by electronic means, and unless you request it otherwise, we shall provide the information in a commonly used electronic form. The right to obtain a copy shall not adversely affect the rights and freedoms of others.

Right to rectification (Art. 16 GDPR)
You shall have the right to obtain without undue delay the rectification of inaccurate personal data concerning yourself. Taking into account the purposes of the processing, you shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Right to erasure ("right to be forgotten") (Art. 17 GDPR)
You shall also have the right to obtain from us the erasure of personal data concerning yourself without undue delay and we shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

  • the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
  • you withdraw consent on which the processing is based and where there is no other legal ground for the processing;
  • you object to the processing and there are no overriding legitimate grounds for the processing, or you object to the processing;
  • the personal data has been unlawfully processed;
  • the erasure of personal data is necessary for compliance with a legal obligation in Union or Member State law to which we are subject;
  • the personal data has been collected in relation to the offer of information society services.

Exceptions to this right can be found in Art. 17(2) GDPR.

Where we have made the personal data public and are obliged pursuant to paragraph 1 to erase the personal data, we, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers who are processing the personal data that you have requested the erasure of any links to, or copy or replication of, this personal data.

Right to restriction of processing (Art. 18 GDPR)
You have the right to obtain from us the restriction of processing where one of the following applies:

  • the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of its use instead;
  • the controller no longer needs the personal data for the purposes of the processing, but it is required by the data subject for the establishment, exercise or defense of legal claims, or
  • the data subject has objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.

Where processing has been restricted, your personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or for a Member State.

Notification obligation regarding rectification or erasure of personal data or restriction of processing (Art. 19 GDPR)
The controller shall communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom the personal data has been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it.

Right to data portability (Art 20 GDPR)
You shall have the right to receive the personal data concerning you which you have provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit this data to another controller without hindrance from the controller to which the personal data has been provided, where the processing is based on consent or on a contract and the processing is carried out by automated means where technically feasible.

Right to object (Art. 21 GDPR)
You have the right to object, on grounds relating to your personal situation, at any time to processing of personal data concerning you which is based on a public or a legitimate interest. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

Right to complain
Furthermore, you may claim your right to lodge a complaint before the responsible supervisory authority.

 

 

1.4 Web server logs

When you use our internet service, the connection information is stored in the server log files.
This data includes:

  • IP address of the calling system,
  • browser information such as operating system in use and screen resolution,
  • accessed website,
  • previous website,
  • and time of access.

The web server logs are only utilized for security purposes. We use the log data only for statistical analysis for the purpose of operation, security and optimization of services. However, we retain the right to review the log data at a later stage whenever we have concrete evidence leading to justified suspicion that the data is being used illegally.

 

 

1.5. Contact form

In the context of the contact form, you are entitled to send us any data. This information is forwarded via email by our web server to our company’s PO box. Please bear in mind that communication by way of the contact form is not encrypted. Whenever this communication is confidential, we recommend in your own interest that you use a safe communication channel.

 

1.6. Cookies

This website uses cookies. Cookies are text files which are stored on your terminal. When accessing the website, cookies may be read, transferred and altered. We only use cookies with random, pseudonymous identification numbers. These identification numbers are utilized to evaluate your use of our site. At no stage is the user profile assigned to the name of a natural person. 1.7. Google Analytics

This website uses Google Analytics 4, a web analysis service of Google Inc ("Google"). Google Analytics utilizes so-called "cookies", text files which are stored on your computer, and which allow one to analyze website usage. The cookies contain information regarding interactions that are tracked when using the website.

The data collected by the cookie about your use of this website is transferred to Google servers in the USA and stored there. However, your IP address is shortened in advance by Google within member states of the European Union and in other countries which signed the Agreement on the European Economic Area. Exceptionally, the full IP address is transferred to a Google server in the USA and shortened there.

The US intelligence services can gain access to this data within the scope of their extensive, legal, surveillance powers. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. In addition, Google's own processing, which is not further defined by Google, is provided for the provision and protection of the Analytics service.

The legal basis for our data collection with the Google Analytics software is your consent in pursuant to Art. 6(1)(a) GDPR, which you can withdraw at any time with effect for the future using the procedure described above.

Your data will be automatically deleted after 2 months. Data that has reached the end of its retention period is automatically deleted once a month.

1.8 Log-in area

Whenever data is collected in connection with a user log-in, this is used only for the provision of the particular service. An analysis only takes place in order to guarantee convenient and secure operation of the system.

 

1.9 Newsletter

Whenever you have entered your email address for the sending of a newsletter, we use the data only for the purpose of sending information according to the newsletter registration procedure.

When you register for the newsletter, we store your IP address and the date of registration. The purpose of this procedure is merely to provide evidence in case a third party misuses your email address and registers for receipt of the newsletter without the consent of the beneficiary.

1.10 Participation in surveys or competitions

If you take part in our surveys or competitions, this is done solely on the basis of your consent in accordance with Art. 6(1)(a) GDPR. You can revoke your consent to YMC GmbH via info@ymc.eu at any time, without giving reasons and with effect for the future. After receipt of the declaration of revocation, your data may no longer be processed. The data will be deleted immediately. Withdrawing your consent does not affect the legality of the processing that has taken place up to that point.

 

1.11 Leadz®: Registration and unsubscription

As a website user, you have the option of registering on our website by providing your personal data and subscribing to the newsletter at the same time. Our service package includes both full access to the exclusive content of our portal and registration for the corresponding newsletter. With your registration, you agree to be contacted by email for promotional purposes. If you no longer wish to receive our newsletter at all, please unsubscribe the first time you receive it or inform us personally by sending an email to unsubscribe@web.ymc.eu. However, you can unsubscribe from our newsletter at any time. For this purpose, you only need to click on the unsubscribe link located at the end of each newsletter e-mail.

Despite unsubscribing from the newsletter, all of our expert knowledge on the website will still be available to you. Which personal data is transmitted to us can be seen from the respective input mask used during the registration. The personal data you enter is processed exclusively for our own purposes within the Leadz system. Leadz processes the following data: Name, first name, e-mail, address data, IP address and user traffic on connected websites, i.e. buttons you click, documents you download and forms you submit. The data is processed in an encrypted database. The data will only be processed as long as you maintain the account you have activated. After deletion of your account, your personal data will be completely deleted. To delete your account, please contact unsubscribe@web.ymc.eu. If you wish to use our services again, you will need to register again. Alternatively, you have the option to temporarily deactivate your account. All you have to do is click on the following opt-out link.

Opt-out from Leadz®
If you choose the opt-out solution, all personal data concerning you that has been stored in the system up to the time of the opt-out will initially remain in the Leadz system.
You have the option of reactivating your account at any time via a corresponding opt-in button in order to continue using our full range of services. A new registration is not necessary in this case.

Leadz® Opt-in
Insofar as we use an order processor for our Leadz system, this is done in compliance with the requirements of Art. 28 GDPR.

When registering on our website and subscribing to the newsletter at the same time, the IP address assigned by the Internet Service Provider (ISP) and used by the data subject, the date and time of registration are also stored. The storage of this data takes place against the background that only in this way can the misuse of our services be prevented and, if necessary, the clarification of committed crimes be made possible. This data is not passed on to third parties unless there is a legal obligation to pass on the data or the passing on serves the purpose of criminal prosecution.

 

1.12 Social Media

Links from LinkedIn and Xing are integrated on our website. After clicking on the integrated graphic, you will be redirected to the page of the respective provider, which means that only then will user information be transmitted to that respective provider. We use the services of LinkedIn Ireland Unlimited Company (‘LinkedIn’), Wilton Plaza, Wilton Place, Dublin 2, Ireland to present our company and as part of the search for new employees.

If you visit our LinkedIn page and react to our content, your personal data such as your user name, the content you publish on LinkedIn and your reactions to content from our company may be processed by us in such a way that we reply to them or mention your account or your content in content published by us.

LinkedIn processes the data you share with LinkedIn when you visit, follow or interact with our page. This processing of personal data serves our legitimate interest in communication via the LinkedIn medium and the optimisation of our offer on this medium. The legal basis for this processing is our overriding legitimate interest in this processing in accordance with Art. 6 para. 1 lit. f) GDPR.

LinkedIn is responsible for the further processing of personal data in the context of the use of LinkedIn.

Among other things, LinkedIn processes the data you voluntarily provide when using your LinkedIn account, such as your name, user name, email address and telephone number.

If you publish and share content on LinkedIn, LinkedIn can analyse it to find out which topics you are interested in in order to provide you with information on similar content and, if applicable, advertising.

1.13 Application and use of Leadinfo

We use the lead generation service of Leadinfo B.V., Rivium Quadrant 141, 2909 LC Capelle aan den IJssel, Rotterdam, Netherlands. This recognises visits from companies to our website based on IP addresses and shows us publicly available information, such as company names or addresses. In addition, Leadinfo sets two first-party cookies to evaluate user behaviour on our website and processes domains from form entries (e.g. ‘leadinfo.com’) in order to correlate IP addresses with companies and improve the services.

Leadinfo acts as a processor. In this regard, we have concluded an agreement with Leadinfo in accordance with Art. 28 GDPR.

Leadinfo will only process your personal data with your prior express consent in accordance with Art. 6 para. 1 lit. a) GDPR. You have the right to revoke your consent at any time without giving reasons with effect for the future.
